TKD Rewards Club Membership Program Terms and Conditions

  1. Introduction

1.1         TKD Rewards Club Membership is a customer benefits program managed and conducted by Bunnings Group Limited (trading as Tool Kit Depot), ABN 26 008 672 179. By signing up as a TKD Rewards Club Member, you agree to the Membership Terms and Conditions.

1.3         The Program is designed to provide benefits and offers to Members and to help us better understand our Members and their purchases with us.  

 

  1. Definitions and Interpretation

“Australian Consumer Law” means Schedule 2 of the Competition and Consumer Act 2010 (Cth).

“Member” means an individual or entity who has signed-up for the TKD Rewards Club Program in accordance with the Terms and Conditions, and whose application for Membership has been accepted by Tool Kit Depot, and whose Membership has not been terminated by Tool Kit Depot or the Member. 

“Member Profile” or “Profile” means the personal details of the Member. “Membership” means being a Member of the Program. 

“Program” means the TKD Rewards Club Program. 

“Rewards” means rewards or other benefits given to Members as a consequence of purchasing behaviours, incentives and/or promotions.

“Team” means all current employees of Tool Kit Depot. 

“Term” means the period from the date of notification of acceptance of your Membership by us.  

“Terms and Conditions” means the terms and conditions applicable to the Program as set out here and as amended from time to time in accordance with clause 10. 

“TKD BUCKS” means credits earned and redeemed at Tool Kit Depot stores within Australia or online at www.toolkitdepot.com.au. TKD BUCKS cannot be earned and redeemed at Bunnings or other Bunnings Group brands. TKD BUCKS are in in AUD.

“TKD BUCKS Balance” means the balance of TKD Bucks.

“Tool Kit Depot” means Bunnings Group Limited trading as Tool Kit Depot, ABN 26 008 672 179.

“us” means Tool Kit Depot.

“Valid Purchase” means all purchases excluding gift cards and selected TKD merchandise which Tool Kit Depot determines will not be eligible to earn Rewards. Any purchases which are returned will not constitute Valid Purchases. “we” means Tool Kit Depot.

“Website” means our website at toolkitdepot.com.au.

“you” means you, being an individual or entity that is a prospective, current or former Member.

 

  1. Membership Sign-Up

3.1.        To become a TKD Rewards Club Member, you must:

(a)         provide accurate and complete information during the sign-up process; and. 

(b)         meet the eligibility criteria in clause 4.  

3.2         A non-transferrable physical Membership card may be provided and/or issued for this Program. 

 

  1. Eligibility

4.1         Membership is free to all Australian residents aged 18 years or over.   

4.2         Memberships are limited to one Membership per person.

4.4         Items purchased using benefits derived from Membership in the Program are not transferrable and cannot be resold for profit.

4.5         By signing up for Membership you confirm that:

(a)         you have read, understood, and accepted the Terms and Conditions;

(b)         you have read and understood the Tool Kit Depot Privacy Policy (available at toolkitdepot.com.au/privacy-policy and on request); and

(c)          you are eligible for Membership of the Program. 

4.6         Membership continues subject to the termination or cancellation of Membership by the Member or Tool Kit Depot.

 

  1. Membership Benefits

5.1         As a TKD Rewards Club Member, you will be entitled to exclusive benefits, including special promotions, and access to Members-only content, offers, discounts and events. 

5.2         The TKD Rewards Club Membership benefits are subject to change, and Tool Kit Depot reserves the right to modify or terminate the Program at any time, without prior notice, unless the changes are adverse to you, in which case Tool Kit Depot will provide you with reasonable notice of any changes to the Program

5.3         Some Membership benefits may be subject to additional terms, conditions and exclusions which we will make available to you when communicating about the benefit.

 

  1. TKD BUCKS

6.1        Earning TKD BUCKS

  • The Tool Kit Depot Rewards Club Program operates by attributing different TKD BUCKS (as nominated by Tool Kit Depot from time to time) to Members of the program.
  • Members who complete a transaction:
  1. in-store, by identifying themselves as a TKD Member at the point of sale, will have the applicable TKD BUCKS applied to their Member Profile within 48 hours after the sales invoice has been given or electronically sent to the customer.
  2. online, by logging into their online Member account, will have the applicable TKD Bucks applied to their Member account within 48 hrs after the sales invoice has been electronically sent to the customer.
  • The value of TKD BUCKS during each promotion will be outlined in the promotional Terms and Conditions available on the Website.
  • Where we have your consent, Tool Kit Depot will endeavour to notify the Member via email when the member is entitled to TKD BUCKS and/or when TKD BUCKS are close to expiring. If a Member unsubscribes from Tool Kit Depot Rewards Club promotional emails and SMS, they will no longer receive TKD BUCKS Balance emails notifying them of expiring TKD BUCKS.
  • Members may receive emails from Tool Kit Depot from time to time notifying them of the special offers and/or promotional activity. Members can direct any questions about special offers or promotional activity to our team at customercare@toolkitdepot.com.au.
  • Tool Kit Depot reserves the right to withdraw, cancel or vary the TKD BUCKS at any time by giving you reasonable notice, including if the TKD REWARDS are awarded in error or are earned fraudulently.
  • TKD BUCKS cannot be earned on any portion of a transaction when you use TKD BUCKS as a form of payment.
  • TKD BUCKS cannot be earned on Festool, Fein, or Coastmac products.
  • TKD BUCKS cannot be earned on purchases of gift cards.
  • If a Membership is terminated from the Toolkit Depot Rewards Club, all existing and future TKD REWARDS will no longer be valid and will be rendered null and void.
  • Members can review their TKD BUCKS Balance by logging into their Member Account online.

 

6.2        Redemption of TKD BUCKS

  • Members with an active Member Status are eligible to redeem TKD BUCKS.
  • TKD BUCKS can only be redeemed at Tool Kit Depot stores, and on the Website in Australia. TKD BUCKS cannot be redeemed at Bunnings and other Bunnings Group Retailer.
  • To redeem any applicable TKD BUCKS when transacting online on the Website, a Member must ensure they are logged into a valid account.
  • The currency in which TKD BUCKS are redeemed will be AUD.
  • TKD BUCKS cannot be redeemed on Festool, Fein, or Coastmac products.
  • TKD BUCKS cannot be redeemed against purchases of gift cards.
  • All TKD BUCKS have an expiry date listed with the TKD BUCKS, at which point they will no longer be available for redemption and will be removed from your Member account. Tool Kit Depot will outline the expiry date within the promotional terms and conditions on the website.
  • Only TKD BUCKS from one Tool Kit Depot Member Profile can be redeemed per transaction.
  • TKD BUCKS can be redeemed as payment for purchases using a Buy Now Pay Later provider (such as Afterpay or ZIP Pay) at the time of purchasing before the first payment takes place.
  • Tool Kit Depot will not be held responsible or liable if TKD BUCKS are not able to be redeemed for reasons such as a technical issue beyond Tool Kit Depot’s control, including the failure of software or hardware or an EFTPOS malfunction.
  • TKD BUCKS can only be redeemed once.
  • Tool Kit Depot reserves the right to exclude certain items and promotions from being redeemed by using TKD BUCKS.
  • Returns:
    1. Our Returns Policy will apply in relation to purchases using TKD BUCKS. Nothing in these terms or the Returns Policy excludes, limits or modifies any rights customers may have under the Australian Consumer Law.
    2. To the extent permitted by law, where you purchase products using a combination of TKD BUCKS and another payment method, and if you want to return the product(s), you’ll be refunded what you paid but the TKD BUCKS will be forfeited.
  • Any TKD BUCKS that were earned from the original purchase will be forfeited.
  1. Any TKD BUCKS redeemed or utilised during the original purchase can be honoured for an exchange in store and online, otherwise they will be forfeited.

 

6.3 Communication

  1. a)        By signing up to the Program, you consent to receiving promotional communications, including emails, SMS, and promotional materials, from Tool Kit Depot. 
  2. b)         You may choose to opt-out of receiving promotional communications, or a specific method of promotional communications, by following the unsubscribe instructions provided in our communications. You understand that if you opt-out of promotional communications, you may not be able to receive some of the Membership benefits available to you (for example, offers that require a personalised ‘discounts offers ’ code).
  3. c)         Notwithstanding any opt-out under clause 6.3 b), we may continue to send you administrative and other non-promotional communications.

 

  1. Account Data

7.1         Tool Kit Depot will collect and store your account information including, but not limited to your name, phone number, email address, and purchase history. Our Privacy Policy contains further details about our handling of personal information.

7.2         You are responsible for maintaining the confidentiality of your account information and ensuring the security of your login credentials.

7.3         Where there are changes to your account information, you must promptly update that information by emailing our Team at customeraccounts@toolkitdepot.com.au.

 

  1. Termination of Membership

8.1         Tool Kit Depot reserves the right to terminate your Membership at its discretion (acting reasonably) if, for example, you engage in suspected dishonest and fraudulent conduct, breach these Terms & Conditions or engage in inappropriate behaviour towards our staff. Tool Kit Depot will provide you with reasonable notice outlining the reason(s) for termination and the effective date. Tool Kit Depot retains the right to immediate termination if reasonably necessary to protect Tool Kit Depot’s legitimate interests.  

8.2         You may also voluntarily terminate your Membership at any time by contacting our team at  customercare@toolkitdepot.com.au.

 

  1. Liability

9.1         To the extent permitted by applicable law (including under the Australian Consumer Law), Tool Kit Depot shall not be liable for any loss, damage, or injury resulting from your Membership in the Program or your use of the Membership benefits. 

9.2         Except for rights, benefits or warranties which cannot be excluded at law (including the consumer guarantees under the Australian Consumer Law), Tool Kit Depot disclaims all warranties, express or implied, regarding the Program and its benefits. 

  1. Changes to Terms and Conditions

10.1       Tool Kit Depot reserves the right to modify these Terms and Conditions at any time. Subject to clause 10.2, any changes will be effective immediately upon posting on our Website. 

10.2       Tool Kit Depot will provide you with reasonable notice of any changes to the Terms and Conditions where the changes may be adverse to you.

10.3       It is your responsibility to review these Terms and Conditions periodically to stay informed of any updates.

10.4       You may terminate your Membership if you do not agree to any changes to the Terms and Conditions. 

 

  1. Other Terms

11.1       If you use our Website, or order goods and services, then our Terms of Sale and Delivery, Website Terms of Use and Returns Policy also apply to you. These are available on our Website and are updated from time to time.

11.2       We may offer competitions to Members from time to time. These competitions may also be subject to additional terms and conditions which you must accept to enter the competition.

 

  1. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. You submit to the non-exclusive jurisdiction of the courts of that State.
